South Carolina Family Court and Circuit Court Mediation
A South Carolina certified family court and circuit court mediator serving Rock Hill, Fort Mill, Tega Cay, Lake Wylie, Clover, and all of York County, with offices just across the state line.
Mediation is part of most South Carolina cases
South Carolina’s Court-Annexed Alternative Dispute Resolution Rules make most civil actions filed in circuit court, and most contested issues in domestic relations actions filed in family court, subject to court-ordered mediation. There are exceptions, and some matters such as requests for temporary relief or contempt proceedings are handled differently, but for most York County families and litigants, mediation is a required step before a final hearing or trial. Parties can usually choose their own certified mediator; if they do not, one may be appointed.
Christopher Adkins is a South Carolina certified family court mediator and circuit court mediator, in addition to his North Carolina certifications. That combination is especially useful for families and businesses in Rock Hill, Fort Mill, Tega Cay, Lake Wylie, Clover, and York whose lives and disputes cross the state line.
South Carolina family court mediation
Family court mediation can resolve every issue in a separation or divorce:
- Custody and visitation: parenting schedules, holidays, school and medical decisions, and exchanges between York County and Mecklenburg County homes.
- Child support: calculated under the South Carolina Child Support Guidelines, plus health insurance and childcare.
- Alimony: South Carolina recognizes several forms of alimony, including periodic, lump-sum, rehabilitative, and reimbursement alimony.
- Equitable apportionment: dividing marital property and debt under South Carolina’s statutory factors.
- Attorney’s fees and costs: often negotiated as part of a global settlement.
South Carolina allows a no-fault divorce after the spouses have lived separate and apart without cohabitation for one year, and it also recognizes fault grounds. A mediated agreement is typically presented to the family court for approval so it can be incorporated into the final order.
South Carolina circuit court mediation
Contract, business, real estate, construction, and personal injury cases in York County’s circuit court generally must be mediated before trial. We handle these cases with the same preparation we bring to North Carolina superior court mediations: early contact with counsel, confidential position statements, and a signed term sheet before the session ends. Civil mediation.
When a case could be in North Carolina or South Carolina
Where a custody case belongs usually depends on the child’s home state under the Uniform Child Custody Jurisdiction and Enforcement Act, generally where the child has lived for the six months before a case is filed. Property, support, and divorce questions have their own jurisdiction rules. Because a mediator cannot give legal advice, parents in cross-border situations should consult an attorney about which state’s court is appropriate. Mediation itself can take place before that question is ever litigated, and a mediator certified in both states can help families reach agreements that work on both sides of the line.

Only if the mediator meets South Carolina’s certification requirements. Christopher Adkins is certified in South Carolina as a family court and circuit court mediator.
