About mediation

What is mediation?

Mediation is a confidential negotiation led by a neutral mediator who helps the parties communicate, evaluate options, and reach their own agreement. The mediator does not decide the case or give either side legal advice.

Is mediation binding?

The discussion is not binding, but a written agreement signed by the parties generally is. Depending on the case, the agreement may be a contract, a separation and property settlement agreement, or a consent order entered by the court.

Is mediation confidential?

Generally, yes. North Carolina and South Carolina rules protect most mediation communications from being used as evidence, with limited exceptions such as reports of child abuse or threats of harm.

How long does mediation take?

Many family and civil mediations are completed in one session of a half day to a full day. Complex divorces or multi-party disputes may need more than one session.

Can mediation be done virtually?

Yes. We offer secure video mediation, which is helpful when parties live in different cities or states, or when safety or scheduling makes in-person sessions difficult.

Family and divorce mediation

Do we need lawyers to mediate our divorce?

No, but it is wise for each spouse to consult an attorney before signing a final agreement, because the mediator is neutral and cannot advise either spouse.

Is custody mediation required in North Carolina?

When a custody case is filed and custody or visitation is contested, North Carolina courts generally refer the case to the court’s free custody mediation program unless mediation is waived for good cause.

What is a mediated settlement conference in a family case?

It is a court-ordered mediation under North Carolina’s Family Financial Settlement program to resolve equitable distribution, alimony, child support, and related claims. Christopher Adkins is a certified family financial mediator.

Can we mediate before we have been separated for a year?

Yes. The one-year separation requirement applies to the absolute divorce, not to negotiating a separation agreement.

Can a mediated agreement be changed later?

Property divisions are generally final. Custody and child support can be modified if circumstances change substantially, and many parents agree to return to mediation before filing a motion.

Civil, business, and estate mediation

Is mediation required in NC superior court?

In most superior court civil actions, yes. North Carolina requires a mediated settlement conference before trial, with limited exceptions.

Do you mediate South Carolina cases?

Yes. Christopher Adkins is a South Carolina certified family court and circuit court mediator and serves Rock Hill, Fort Mill, and York County.

Can the Clerk of Superior Court order mediation of an estate dispute?

Yes. North Carolina clerks may refer estate, guardianship, and certain special proceedings, such as partition disputes, to mediation.

Scheduling and fees

How much does mediation cost?

Private fees depend on the type of case and time required and are usually shared by the parties. When a North Carolina court appoints a mediator, court rules set the fee. Call or text (704) 231-5762 for current rates.

Where are your offices?

9620 Sherrill Estates Road, Huntersville, NC 28078, and 217 W. Main Street, Locust, NC 28097. Virtual sessions are available throughout North and South Carolina.

How do we schedule?

Call or text (704) 231-5762, or send a message through our secure contact form. We will ask a few questions about the dispute and the other parties, then propose dates.
