Dividing Retirement Accounts and Pensions in Mediation
QDROs, IRA transfers, pensions and survivor benefits, military retirement rules, and how to trade retirement assets without a tax surprise.
Not all retirement assets divide the same way
- 401(k), 403(b), and other employer plans. Divided with a qualified domestic relations order, commonly called a QDRO, which instructs the plan administrator to create a separate interest or pay a share to the former spouse.
- IRAs. Divided by a transfer incident to divorce rather than a QDRO. Done correctly, the transfer is not a taxable event; done wrong, it can trigger tax and penalties.
- Defined benefit pensions. Usually divided as a share of the benefit earned during the marriage, often using a coverture fraction. Survivor benefit elections matter as much as the monthly share.
- Government and military plans. These have their own rules and forms. Military retirement division is governed by federal law and has specific requirements.
- Stock options and deferred compensation. Vesting schedules determine what is marital, and transfer restrictions often force creative solutions.
Comparing apples to apples
A dollar in a traditional 401(k) is not a dollar in a savings account, because taxes are due when it comes out. A Roth dollar is different again. Before trading the house against retirement funds, adjust for tax treatment, penalties for early withdrawal, and liquidity. A settlement that looks equal on paper can be badly unequal in practice.
Getting the QDRO right
- Decide the formula. A fixed dollar amount, a percentage as of a date, or a share of the marital portion. Say whether gains and losses between the valuation date and the transfer date follow the award.
- Assign responsibility. Name who drafts the order, who pays the drafting fee, and a deadline for submission.
- Pre-approve with the plan. Most administrators will review a draft. That step prevents rejected orders months later.
- Address survivor benefits. For pensions, decide who is covered and who pays for the coverage.
- Confirm completion. Set a date for confirming the transfer happened, because unexecuted orders are a common and expensive surprise years later.
Military and government retirement
Military retirement can be divided as property under federal law, with particular rules about how the award is expressed. Direct payment from the Defense Finance and Accounting Service generally requires at least ten years of marriage overlapping ten years of creditable service, often called the 10/10 rule. Survivor Benefit Plan coverage for a former spouse must be elected and, when required, a deemed election request submitted within one year of the divorce. State and federal civil service plans have their own procedures. See our military divorce guide.
Why this belongs in mediation
Retirement division is technical, and litigation about it is expensive relative to the amounts often in dispute. In mediation, spouses can agree on a valuation date, choose whether to split each account or offset one against another to reduce paperwork, and set clear deadlines for the orders. A common and sensible outcome is to divide one large account rather than slicing every account in half, which saves fees and simplifies everyone’s life.

Frequently asked questions
Is a QDRO needed for an IRA?
No. IRAs are generally divided by a transfer incident to divorce under the terms of the agreement or order, not by a QDRO.
Who pays to prepare the QDRO?
That is negotiable. Many agreements split the drafting cost or assign it to the spouse receiving the transfer.
Can we avoid splitting every account?
Yes. Offsetting is common: one spouse keeps a retirement account while the other receives equivalent value elsewhere, adjusted for taxes.
What is the 10/10 rule?
For military retirement, direct payment from DFAS generally requires ten years of marriage overlapping ten years of creditable service. It affects how payment is made, not whether retirement can be divided.
