Parents who cannot be in the same room can still build a parenting plan. The format changes, the detail increases, and safety comes before everything else. Screening comes first, alwaysNot every case belongs in a mediation room, and a responsible mediator says so. Before a session is scheduled we ask about protective orders, criminal charges, substance use, threats, and whether either parent is afraid of the other. North Carolina recognizes this directly: a party can ask the court to waive custody mediation for good cause, and the grounds include allegations of abuse or neglect of the child, alleged domestic violence between the parties, alleged severe psychological or emotional abuse, and substance abuse, along with practical grounds like a party living more than fifty miles from the court. Waiver is a right, not a failure. If a case is not appropriate, saying so early is worth more than a session that retraumatizes someone. When mediation still worksHigh conflict and unsafe are not the same thing. Plenty of parents cannot hold a civil conversation, text each other forty times a day, and still need a schedule for next Tuesday. For them mediation often works better than a courtroom, because the format can be adapted in ways a hearing cannot.
Structure is what makes these sessions productive. The goal is a workable document, not a reconciliation. Detail is the safety featureIn a low-conflict family, a plan that says "as the parents agree" works fine. In a high-conflict family, that phrase is an invitation to a fight every week. The antidote is specificity.
In high-conflict cases the second column is what keeps parents out of court. Protective orders and custody termsA domestic violence protective order can include temporary custody provisions, and those terms control while the order is in effect. Any mediated parenting plan has to be written so it does not conflict with an existing order, and where one exists the safer course is usually to leave the protective order terms in place and mediate only the areas it does not cover, with counsel involved. Where sessions happenSessions are held at the Huntersville office on Sherrill Estates Road, at the Locust office on West Main Street, or entirely online for parents in Charlotte, Mecklenburg County, Stanly County, Cabarrus County, Albemarle, Rock Hill, and Fort Mill. Online sessions are frequently the right answer in these cases, and there is no disadvantage to the agreement that results.
